General Terms and Conditions of Sale for Services to Individuals (translated from French)
Only the French version of these Terms & Conditions is contractual. The following is an informal translation to English provided solely for the client’s convenience.
The terms “client” or “customer” refer to any individual engaging the services of Alice Dauriach.
1- General Provisions
These General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to all services (hereinafter the “Services”) offered by Nordiska—a sole proprietorship (micro-entreprise) registered by Alice Dauriach under SIRET number 808382444 00038—to all its clients, regardless of their status.
Consequently, placing an order for a service offered—whether directly at the massage studio located at the Beauty Room of Hife Toulouse Labège, 1151 L’Occitane, 31670 Labège—implies the client’s adherence to and unreserved acceptance of these GTCS, unless a specific agreement has been reached in writing between the parties beforehand.
Nordiska reserves the right to modify these GTCS at any time; however, such modifications shall apply only to orders placed after the modifications have come into effect.
Any document other than these GTCS (such as advertisements, brochures, flyers, etc.) is for informational purposes regarding Nordiska’s activities and is non-contractual.
2- Essential Characteristics of the Services
The Services offered are those listed on the website https://nordiska.fr/prestations/ and at the massage studio, namely:
- Individual wellness massage sessions
- Gift cards for these same services
The “client” or “customer” is the person who books a service or purchases a gift card. The “beneficiary” is the person who receives a gift card.
3- Conditions for Service Delivery
The sole purpose of Nordiska’s activity is the individual’s well-being. In accordance with applicable regulations, the wellness massages performed by Alice Dauriach—conducted without medical diagnosis or therapeutic treatment—do not resemble, in either content or purpose, the practice of physiotherapy or any other medical, therapeutic, or sports-related practice. These are strictly manual techniques for wellness and relaxation. Services of an erotic or sexual nature are expressly excluded from Alice Dauriach’s activities. Any inappropriate behavior towards Alice Dauriach may result in legal action.
4- Conditions for Service Delivery
4A- Service Locations
Nordiska operates by appointment only at the following location: Beauty Room at Hife Toulouse Labège, 1151 L’Occitane, 31670 Labège.
4B- Service Days and Hours
Services are offered during the following hours:
Tuesday: 9:30 AM – 5:00 PM
Thursday: 9:30 AM – 5:00 PM
Friday: 9:30 AM – 7:00 PM
Saturday: 9:30 AM – 1:00 PM
For wellness massage sessions at the salon located at 1151 L’Occitane, 31670 Labège, Nordiska provides all necessary equipment (massage table, sheets, towels, cream).
4C- Booking Appointments
Appointments may be booked online via the Square platform, by telephone, or by email. All contact details and links required for booking are available on the nordiska.fr website. An invoice will be issued for any booking made by telephone. A deposit of €15 (fifteen euros) for 30-minute or 60-minute sessions, and €25 (twenty-five euros) for 90-minute or 120-minute sessions, is required at the time of booking. This can be paid either via bank card or gift card.
4D- Modification and cancellation terms
Clients may modify or cancel their booking free of charge up to 3 (three) days before the appointment via the Square platform, by email, or by phone. In the event of a cancellation initiated by the client at least 3 (three) days prior to the appointment, Nordiska will refund the collected deposit to the client within a maximum of 8 (eight) days.
If the client modifies or cancels the booking within the 3 (three) days preceding the service, the deposit will not be refunded (unless proof of force majeure is provided). In the event of a no-show without prior notice, the full cost of the session will be due.
In the event of a cancellation initiated by Nordiska where no alternative date is agreed upon, Nordiska will refund the collected deposit to the client within a maximum of 8 (eight) days.
4E- Payment
For all bookings, the deposit is paid online via the Square platform using a bank card or gift card. Payment of the remaining balance for the massage is made at the massage studio following the service, via bank card, cash, check, or gift card.
4F- Handling Delays
Nordiska schedules appointments to avoid delays. A buffer period is included between massages to ensure the next client can be welcomed under the best possible conditions.
Clients are asked to arrive at the scheduled time or a few minutes early. If a client arrives 10 (ten) minutes or more late, the session will be shortened accordingly so as not to keep subsequent clients waiting. The full cost of the session will still be due.
Nordiska reserves the right to refuse service to a client if the delay is too significant to allow for a proper massage session. The deposit will not be refunded.
In the event of a no-show for a booked session without prior notice from the client, the full cost of the session will be due.
5- Gift Cards
Clients may purchase a “gift card” for a third-party recipient. For gift card purchases via the Square platform, payment is made directly online by bank card. For on-site purchases, payment is made at the massage studio via bank card, cash, or check.
The “gift card” will be sent via SMS or email (at the client’s choice) only after full payment has been received and processed. The recipient may then book an appointment with Nordiska. Upon customer’s request, Nordiska will provide a physical gift card—available for in-store pickup or by mail—at no extra cost.
A 14-business-day cooling-off period applies from the date payment is received, requiring no justification or penalty. Nordiska will refund the amounts paid by the client within a maximum of 30 (thirty) days of receiving the original “gift card” (if provided in physical card format), or within 8 (eight) days of the request made by the customer in the case of a digital gift card alone (provided that no part of the gift card balance has been used).
The “gift card” is valid for 12 (twelve) months from the date of purchase. It will not be replaced or refunded in the event of loss, theft, or expiration. After 12 (twelve) months, a “6-Month Extension Pass” may be purchased for €10 (ten euros) to extend the gift card’s validity by 6 (six) months.
6- Contraindications for wellness massages
Each client must comply with Nordiska’s advice and recommendations, particularly regarding contraindications for wellness massages.
By reading these Terms and Conditions of Sale, the client acknowledges and accepts that performing a wellness massage without prior medical advice is contraindicated for individuals suffering from—including but not limited to—fever, active infections (viral, bacterial, etc.), phlebitis, inflammation of the blood vessels, severely calcified arteries, contagious or uncomfortable skin conditions, recent injuries or inflammation (acute phase), cancer, diabetes, or epilepsy.
In the event of allergies, the client agrees to inform Nordiska when booking the appointment.
In the event of pregnancy, clients are advised to seek prior approval from their doctor, gynecologist, or midwife and to inform Nordiska when booking the appointment.
To ensure the client is fit to receive a wellness massage, Alice Dauriach reiterates the aforementioned contraindications during the first appointment. To proceed with the massage, the client must confirm that there is nothing regarding their health status that would be incompatible with receiving a wellness massage without medical advice, and agrees to inform Alice Dauriach in advance of any changes to their health status for future appointments.
Consequently, Alice Dauriach reserves the right to refuse service at any time to a client whose health status is incompatible with receiving a wellness massage without prior medical advice. The full fee for the session will be payable.
Similarly, massage sessions are offered only to adults over the age of 18 (eighteen).
7- Financial Terms
The rates for the services offered are listed in euros on the nordiska.fr website and at the massage studio located at 1151 L’Occitane, 31670 Labège. Prices are fixed and final, except during promotional offers.
Nordiska is subject to Value Added Tax (VAT); therefore, the prices listed on the website are inclusive of all taxes (TTC). Intra-Community VAT number: FR01808382444.
Nordiska reserves the right to modify its prices at any time; however, services will be billed based on the rates in effect at the time the appointment is booked or the gift card is purchased.
8- Inability to Work
In the event of Alice Dauriach’s temporary physical inability to work due to illness or accident, Nordiska reserves the right to reschedule appointments in consultation with the client, without the client being entitled to claim any compensation. In the event of Alice Dauriach’s permanent physical inability to work, all contracts or commitments with Nordiska clients shall be automatically terminated, and no compensatory payment may be claimed from Nordiska.
9- Governing Law and Jurisdiction
These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution prior to any legal action. The client has the option to consult a consumer mediator from the organization Société Médiation Professionnelle (Alteritae, 5 rue Salvaing, 12000 Rodez).
Failing this, any dispute arising with a client shall be subject to the exclusive jurisdiction of the courts of Toulouse (31).
